Senate Bill SBx7-7 2009
On February 1, 2012, DWR will hold a workshop to discuss DWR's proposed Agricultural Water Management Plan Guidebook. The purpose of the Guidebook is to assist agricultural water suppliers in complying with the requirement to submit an agricultural water management plan to DWR by December 31, 2012 per SBx7-7 (Water Conservation Act of 2009). Agricultural Water Measurement Regulation.
Pursuant to the requirements of Government Code section 11346.8 (c), and section 44 of Title 1 of the California Code of Regulations, the Department of Water Resources is providing notice of changes made to the proposed Agricultural Water Measurement regulation text (Title 23, Division 2 of the California Code of Regulations, Chapter 5.1, Sections 597, 597.1, 597.2, 597.3, and 597.4) and a Supplement to the Initial Statement of Reasons. The changes made to the text of regulation, that was released to the public on March 26, 2012, are in response to comments received from stakeholders and the California Water Commission decision on April 18, 2012. DWR is conducting a fifth 15-day public comment period in accordance with the Administrative Procedures Act. Written comments will be accepted between April 19, 2012 and May 3, 2012. The Final Statement of Reasons of the Process Water Exclusion Regulation, pursuant to Administrative Procedures Act Government Code Section 11346.9, was approved by the Office of Administrative Law on 7-8-2011.
Regulation on Industrial Process Water
The Department of Water Resources (DWR) submitted a Certificate of Compliance, following the Emergency rulemaking file #2010-1207-01 E, regarding the local water purveyors' deduction of Industrial Process Water from their gross water calculation, to the Office of Administrative Law (OAL) on February 22, 2011. This proposed regulation was approved by the California Water Commission at their February 16, 2011 meeting. This regulation was published in the California Regulatory Notice Register on March 4, 2011. The public comment period closes April 19, 2011. For more information, click here.
2010 Urban Water Management Plans
In February and March 2011, DWR hosted several workshops throughout the state to assist urban water suppliers in writing their 2010 Urban Water Management Plans (UWMP). Commercial, Industrial, and Institutional (CII) Task Force Convenes. The Commercial, Industrial, and Institutional Task Force (CII TF) will convene on Tuesday March 1, 2011 and will be hosted by the California Urban Water Conservation Council. The Task Force will assess the potential statewide water use efficiency improvements in CII sectors that would result from implementation of the alternative BMPs. For more information, click here.
Provisional Target Method 4 Released. The Department of Water Resources has released the Provisional Target Method 4 and its associated calculator. For more Information, click here.
Emergency Regulation on Industrial Process Water in Effect. On December 17th, the Office of Administrative Law (OAL) approved the Emergency Regulation on Process Water. The regulation is now in effect for 180 days and DWR will be submitting a permanent regulation for public and OAL review at the beginning of the new year. Senate Bill x7-7 was enacted in November 2009, requiring all water suppliers to increase water use efficiency. Below are the highlights of this legislation, divided into two sectors, Urban Water Conservation and Agricultural Water Conservation.
The bill also requires, among other things, that the Department of Water Resources, in consultation with other state agencies, develop a single standardized water use reporting form, which would be used by both urban and agricultural water agencies.
Urban Water Conservation
The legislation sets an overall goal of reducing per capita urban water use by 20% by December 31, 2020. The
state shall make incremental progress towards this goal by reducing per capita water use by at least 10% by
December 31, 2015.
- Each urban retail water supplier shall develop water use targets and an interim water use target by July 1, 2011.
- An urban retail water supplier shall include in its water management plan due July 2011 the baseline daily per capita water use, water use target, interim water use target, and compliance daily per capita water use. The Department of Water resources, through a public process and in consultation with the California Urban Water Conservation Council, shall develop technical methodologies and criteria for the consistent implementation of this part
- The Department of Water Resources shall adopt regulations for implementation of the provisions relating to process water.
- A Commercial, Institutional, Industrial (CII) task force is to be established that will develop and implement urban best management practices for statewide water savings.
- Effective 2016, urban retail water suppliers who do not meet the water conservation requirements established by this bill are not eligible for state water grants or loans.
Agricultural Water Conservation
- Agricultural water suppliers shall prepare and adopt agricultural water management plans by December 31, 2012, and update those plans by December 31, 2015, and every 5 years thereafter.
- On or before July 31, 2012, agricultural water suppliers shall:
- Measure the volume of water delivered to customers. The Department of Water Resources shall adopt regulations that provide for a range of options that agricultural water suppliers may use to comply with the measurement requirement.
- Adopt a pricing structure for water customers based at least in part on quantity delivered.
- Implement additional efficient management practices.
- Effective 2013, agricultural water suppliers who do not meet the water management planning requirements established by this bill are not eligible for state water grants or loans.
